Case study – Police stops in the Republic of North Macedonia

CASE ANALYSIS

Goran Manojlovski, MP in the Parliament of the Republic of North Macedonia from the opposition party VMRO-DPMNE, on 08.07.2019 left his job in the Parliamentary Committee in protest. Namely, the MP Manojlovski stated “Around 11 o’clock in the Gorce Petrov district roundabout, I was stopped by two police officers armed with automatic rifles and rifles. My vehicle was selectively detached, I was told to park and turn off the vehicle. When I showed my ID they told me it was not valid, a search was made and I was released. If the law on us MPs is not respected what is left for other citizens? It is not true that all vehicles were braked indiscriminately, there are cameras and pictures, it can be seen that my vehicle was selected and excluded from traffic. ”

Regarding the event, the Ministry of Interior stated that, “Police officers from Gjorce Petrov Police Station were placed in connection with a crime (robbery of a bank branch in Saraj) and checks of the vehicles of citizens were carried out, them and to GM without even knowing it was an MP. After the check, the person is allowed to go without any problems. ”

Given the above situation, several questions arise:
– Do police officers know the positive regulations that regulate their powers?
– Do police officers differentiate between “Persons’ view of vehicles, luggage and premises” and “Search”?
– How and how should police officers deal with the braking, inspection and search of persons and vehicles?
– Should police officers have a non-selective approach that guarantees equity for all, non-discrimination and full respect for the principle of legality in their work?
– Do police officers know that certain people enjoy immunity and how should they act when they encounter such a person?

These and other issues are directly related to police authority to “stop, legitimize and carry out the necessary inspection of persons, means of transport and luggage” on the one hand, and “search” on the other.

АНАЛИЗА НА СЛУЧАЈ

 

Горан Манојловски, пратеник во Собранието на Република Македонија од опозициската партија ВМРО-ДПМНЕ, на 08.07.2019 ја напуштил работата во Собраниската комисија во знак на револт. Имено, Пратеникот Манојловски изјавил „Околу 11 часот на кружниот тек во населба Ѓорче Петров, бев сопрен од двајца полициски службеници вооружени со автоматски пушки и панцири. Селективно моето возило беше одделено, му кажаа да се паркирам и да го исклучам возилото. Кога покажав легитимација ми рекоа дека тоа не важи, беше направен претрес и ме пуштија. ,Ако не се почитува законот за нас пратениците што останува за другите граѓани? Не е точно дека сите возила биле сопирани неселективно, има камери и слики, може да се види дека моето возило беше селектирано и исклучено од сообраќај“.[1]

 

Во врска со настанот, од Министерството за внатрешни работи изјавија дека ,,Полициски службеници од Полициската станица Ѓорче Петров биле поставени на позиција во врска со кривично дело (разбојништво на експозитура на банка во Сарај) и вршени се проверки на возилата на граѓаните, а меѓу нив и на Г.М. без притоа воопшто да знаат дека станува збор за пратеник. По извршената проверка, на лицето му е дозволено да си оди без никакви проблеми.“.[2]

 

Имајќи ја предвид горенаведената ситуација, се поставуваат неколку прашања:

  • Дали полициските служеници ги познаваат позитивните прописи со кои се регулираат нивните овластувања?[3]
  • Дали полициските службеници прават разлика помеѓу „Преглед на лица, возила, багаж и простории“ и „Претрес“?
  • Како и на кој начин полициските службеници треба да постапуваат при сопирање, преглед и претрес на лица и возила?
  • Дали полициските службеници треба да имаат неселективен пристап кој ќе гарантира правичност за сите, недискриминација и целосно почитување на начелото на законитост во работењето?
  • Дали полициските службеници знаат дека определени лица уживаат имунитет и како треба да постапуваат кога ќе наидат на вакво лице?[4]

 

Овие и други прашања се директно поврзани полициското овластување да „сопре, легитимира и да изврши потребен преглед на лица, превозни средства и багаж“, од една страна, и „претрес“, од друга страна.[5]

  1. This is interesting case to analyse. Facts are indicating that police stops could be used as political pressure. If police didn’t have any argument (did a vehicle looked like a perpetrator’s car) it supports s conclusion that it was intentionally. It is very unusual to perform full search although nothing pointed to suspicion.

  2. This is an interesting case. I assume that this practice would have been common and has gone unquestionned for years. Only when an MP gets stopped are questions asked. Has there been a continuing discussion since this incident in August last year? Or has it gone quite again?

    This will be an intersting case to follow for Working Group 4 of the COST ACtion.

    1. It is very interesting that police stopped the vehicle even though there was no suspicion for it. Many questions could arise from this situation, perhaps should police have less police powers in situations where there’s no suspicion.

  3. I believe that police officers acted according to the law. Maybe they really didn’t know who that person is, but it could be that person really looked suspiciously.

  4. There is nothing illegal in stoping somebody and asking him for his ID. It doesn’t matter what is his job. If his car is similar to the one used in the robbery. They have that police power and it can be used for that

  5. I think that after the police find out that he is a person with immunity he must release it since the law requires it.

  6. I think that police officers vere doing correct thing. Police should have more powers and should use them against anyone who is considered as suspect even if you’re a politician. More police powers makes people safer.

  7. This is a clear example of political preasure provided by police. Nobody can provide full search without reasonable cause.

  8. If the bank robbery did happened in close area, I think that the police officers apsolutly have to detach the vehicle that looks like the vehicle that perpetrators used when robbing the bank. When they realised that the driver is a head of the opposite party they had to call the supervisor to inform him about it and do the search because they had the car description.

  9. I think police officers were doing their police job,they had a reason why they pulled over that car.I dont know their rules in Macedonia but they needed to call their supervisor and notice him about who they pulled over,and what imunite do politics have in Macedonia in order to crimes.

  10. Very hard is work with small police power, we need big police power for crime prevention
